Abstract:A discussion guide, one in a series on constitutional reform issues developed by The Jefferson Foundation as a part of The Jefferson Meeting on the Constitution project, examines proposals to establish terms of office for the Federal judiciary. The first section discusses the historical background of the Federal judiciary including the issues of appointment, the paradox of independence, and accountability. The British example and the Anti-Federalist opposition are also examined. The second section covers partisanship and the courts and the issue of establishing terms. The third section lists arguments for and against establishing terms and arguments for and against elections by the people. The final section outlines a brief legislative history of judicial tenure form 1791 to 1984. (RSL)
